1. Acceptance of Terms

By accessing or using the Mos Tow Fast website located at https://mostowfast.com (the “Site”), any associated mobile applications (the “App”), or any related call‑center, SMS, or in‑person services (collectively, the “Services”), you (“you” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Services.

2. Services Overview

·        Mos Tow Fast (“Company,” “we,” “our,” or “us”) provides vehicle towing, roadside assistance, and related logistics.

·        All Services are subject to availability, traffic conditions, and applicable law.

3. Eligibility & Jurisdiction

·        You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.

·        You represent that: (a) you have the legal right to request towing of the vehicle; (b) all information you provide is true; and (c) your use complies with all local, state, and federal laws, including towing regulations.

4. Account Registration & Security

·        To schedule certain services or to access the App, you may need to create an account and provide personal information such as name, phone number, email, and payment credentials.

·        You are responsible for maintaining the confidentiality of account credentials and for all activities that occur under your account.

5. Quotes, Pricing & Payment

·        Prices displayed are estimates until service completion; additional fees (e.g., mileage, storage, tolls, after‑hours) may apply.

·        We accept major credit/debit cards and other forms of electronic payment through PCI‑DSS‑compliant processors.

·        By providing payment information, you authorize us to charge all fees incurred.

6. Scheduling, Cancellations & No‑Shows

·        You may cancel a booking up to 30 minutes before the scheduled arrival time without penalty.

·        Cancellations within 30 minutes or failure to appear may incur a non‑refundable service call fee.

7. Mobile App License and Usage

·        Subject to these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to download and use the App on a device you own or control for your personal, non‑commercial use.

·        You consent to receive push notifications and to the App’s use of your device’s GPS data to provide real‑time status updates.

·        We may remotely disable or provide updates to the App that you agree to install to continue using the Services.

8. Vehicle Information & Location Data

·        The Services require accurate vehicle details (VIN, license plate, make/model) and location data. You grant us permission to collect, store, use, and share such data with contractors and insurers to fulfill your request.

9. User Conduct & Prohibited Uses

·        You agree not to: (a) resell or commercialize the Services; (b) interfere with networks connected to the Services; (c) reverse engineer or scrape the Site or App; (d) impersonate another person or misrepresent vehicle ownership; (e) upload viruses or malicious code.

10. Intellectual Property

The Site, App, all content, trademarks, and logos are owned by Mos Tow Fast or its licensors and are protected by intellectual property laws. No rights are granted except as expressly set out in these Terms.

11. Feedback

If you submit feedback or suggestions, you grant us a perpetual, royalty‑free license to use such feedback for any purpose without compensation.

12. Third‑Party Links & Services

The Services may contain links to third‑party sites or integrate third‑party features. We are not responsible for the content or practices of any third‑party services.

13. Disclaimers

·        The Services are provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement.

·        We do not guarantee arrival times, uninterrupted access, or that the Services will meet your requirements.

14. Limitation of Liability

·        To the fullest extent permitted by law, Mos Tow Fast will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from or related to your use of the Services, even if advised of the possibility. Our total liability will not exceed the greater of (a) amounts you paid to us in the 12 months preceding the claim or (b) $500.

15. Indemnification

You agree to defend, indemnify, and hold harmless Mos Tow Fast, its affiliates, and their officers, directors, and employees from any claims or liabilities arising out of your use of the Services or violation of these Terms.

16. Force Majeure

We are not liable for delay or failure to perform due to causes beyond our reasonable control, including severe weather, natural disasters, accidents, pandemics, labor disputes, or governmental actions.

17. Termination & Suspension

·        We may suspend or terminate your access at any time for violation of these Terms or to protect the security of the Services.

·        You may delete your account at any time; however, Sections 10–15 and 18–24 will survive termination.

18. Modifications to Services & Terms

·        We reserve the right to modify or discontinue the Services at any time.

·        We may revise these Terms by posting an updated version with a new “Effective Date.” Continued use after changes constitutes acceptance.

19. Dispute Resolution & Arbitration

·        ANY DISPUTE ARISING FROM THESE TERMS OR THE SERVICES SHALL BE RESOLVED THROUGH BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) UNDER ITS CONSUMER ARBITRATION RULES.

·        YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑laws principles, except that the Federal Arbitration Act governs the interpretation and enforcement of the arbitration clause.

21. Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

22. Severability

If any provision is found unenforceable, the remaining provisions will remain in full force.

23. Entire Agreement

These Terms, together with our Privacy Policy and any additional service‑specific terms, constitute the entire agreement between you and Mos Tow Fast regarding the Services and supersede all prior agreements.
